UNAT first agreed with the UNDT that the abolition of post was not a reviewable administrative decision. Second, UNAT ruled there was no evidence of improper motives regarding the non-renewal of the staff member’s appointment. UNAT dismissed the appeal and upheld the UNDT Judgment. The Tribunal explained although there is no expectancy of renewal, renewal of FTAs are “normally” for a period of two years “at a time”. Because of the words “at a time”, the Tribunal cautioned that although a new FTA would supersede a previous one, it would not necessarily subsume the previous one. UNAT held that UNDT correctly concluded that Mr Russo-Got’s application against the abolition of his post was not receivable, as he had failed to make a request for management evaluation within time.
